1. Acceptance of These Terms

IMPORTANT - PLEASE READ THESE TERMS CAREFULLY.

These Terms of Service ("Terms") govern your access to and use of the STORMCRAFT PC website, online store, customer accounts, content, products, support services, and other services we make available (collectively, the "Services").

Throughout these Terms, "STORMCRAFT PC," "STORMCRAFT," "we," "us," and "our" refer to STORMCRAFT PC.

By accessing or using our Services, creating an account, placing an order, purchasing a product, or otherwise using our website, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, do not use the Services.

THESE TERMS CONTAIN IMPORTANT PROVISIONS REGARDING DISCLAIMERS OF WARRANTIES, LIMITATIONS OF LIABILITY, INDEMNIFICATION, GOVERNING LAW, AND A CLASS ACTION WAIVER. PLEASE REVIEW THESE PROVISIONS CAREFULLY.

Product purchases may also be governed by our Return Policy, Shipping Policy, applicable Warranty, promotional terms, and other policies referenced in these Terms.

PART I - USE OF OUR WEBSITE AND SERVICES

2. Eligibility

You must be legally capable of entering into a binding agreement to purchase products through our website.

If you use the Services on behalf of a business or other organization, you represent that you have authority to bind that organization to these Terms.

You agree to comply with all applicable federal, state, local, and international laws and regulations when using our Services.

3. Accounts and Account Security

Certain portions of our Services may allow or require you to create an account.

You agree to provide accurate, complete, and current information and to update that information when necessary.

You are responsible for maintaining the confidentiality and security of your account credentials and for activity conducted through your account to the extent permitted by applicable law.

You may not permit another person to use your account in a manner that violates these Terms.

If you believe that your account or credentials have been compromised or used without authorization, please contact STORMCRAFT PC promptly.

We may suspend, restrict, or terminate accounts associated with suspected fraud, unauthorized activity, abuse, or violations of these Terms.

4. Permitted Use

STORMCRAFT PC grants you a limited, non-exclusive, non-transferable, revocable right to access and use our website and Services for lawful personal or business purchasing purposes.

This permission does not transfer ownership of any STORMCRAFT PC intellectual property or website content to you.

All rights not expressly granted are reserved by STORMCRAFT PC and the applicable rights holders.

5. Prohibited Uses

You may not use the Services to engage in fraudulent, deceptive, abusive, or unlawful activity; provide false or misleading information; impersonate another person or entity; attempt unauthorized access to accounts, systems, networks, servers, or data; circumvent authentication, security, fraud-prevention, purchasing, or access-control measures; introduce viruses, malware, ransomware, malicious code, or other harmful technology; interfere with the operation or security of our Services; use bots, crawlers, scrapers, spiders, automated scripts, or similar technologies to access, collect, copy, monitor, or extract information without authorization except where prohibited by law; systematically copy product information, pricing, images, specifications, reviews, or other content for commercial purposes without authorization; reverse engineer or decompile the Services except where permitted by law; falsely imply affiliation with or endorsement by STORMCRAFT PC; circumvent quantity or promotional restrictions; engage in unauthorized resale activity involving promotions; collect personal information about other users without authorization; infringe intellectual-property, privacy, publicity, or other rights; or assist another person in prohibited activity.

We may restrict or terminate access to the Services if we reasonably believe these Terms have been violated.

6. Modification or Discontinuation of Services

We may modify, update, suspend, restrict, or discontinue any portion of the website or Services from time to time.

We do not guarantee that every website feature, product listing, service, or functionality will remain continuously available.

To the maximum extent permitted by applicable law, STORMCRAFT PC will not be liable solely because a website feature or Service is modified, suspended, or discontinued.

PART II - PRODUCTS AND ORDERS

7. Product Information

We make reasonable efforts to provide accurate product descriptions, specifications, photographs, compatibility information, pricing, and availability.

However, product information may occasionally contain errors, inaccuracies, or omissions.

Product appearance may differ slightly from photographs because of lighting, display settings, manufacturing revisions, component revisions, or other reasonable variations.

Performance information, benchmarks, frame rates, temperatures, and similar information are estimates or examples unless expressly guaranteed. Actual performance may vary depending on software, drivers, settings, games, workloads, environmental conditions, updates, and other factors.

8. Component Availability and Substitutions

STORMCRAFT PC systems may contain components manufactured by third parties.

Unless a specific manufacturer, model, or part number is expressly identified as guaranteed in the applicable product listing or order confirmation, the brand, appearance, or specific model of an internal component may vary based on availability.

Where substitution is necessary, STORMCRAFT PC may use a component intended to meet the advertised specifications, compatibility, functionality, and performance class of the system.

Substitutions will not intentionally reduce the core advertised system specifications.

9. Pricing and Availability

All prices are stated in U.S. dollars unless otherwise indicated.

Prices, promotions, specifications, bundles, availability, and offers may change before an order is accepted.

We make reasonable efforts to provide accurate pricing. However, pricing or listing errors may occur.

If a product is listed at an incorrect price or with materially incorrect information because of a typographical, technical, system, supplier, or other error, STORMCRAFT PC may correct the error and, where appropriate, contact you before fulfilling the affected order.

You may be given the opportunity to purchase the product at the corrected price or cancel the affected order.

If STORMCRAFT PC cancels an order after collecting payment, the applicable amount will be refunded to the original payment method.

Nothing in this section limits rights available under applicable consumer-protection law.

10. Orders and Acceptance

Submitting an order constitutes an offer to purchase products from STORMCRAFT PC.

An automated order confirmation acknowledges receipt of your order but does not necessarily constitute final acceptance.

We may accept, reject, limit, hold, or cancel an order for legitimate reasons, including product or component unavailability; pricing or listing errors; payment authorization problems; suspected fraud; unauthorized payment methods; identity-verification concerns; billing or shipping-address discrepancies; quantity limitations; errors in product configuration; suspected abuse of promotional offers; purchasing activity reasonably indicating unauthorized resale or fraud; or circumstances that make fulfillment commercially or operationally impracticable.

If we cancel an order after payment has been collected, we will refund the applicable amount to the original payment method.

11. Fraud Prevention and Order Verification

To protect customers and STORMCRAFT PC, orders may be subject to fraud screening and verification.

We may request additional information reasonably necessary to verify customer identity, billing information, shipping information, payment authorization, account ownership, or other transaction information.

An order may be delayed while verification is completed. Failure to complete requested verification may result in cancellation.

We may reject or cancel transactions that we reasonably believe are fraudulent, unauthorized, abusive, or present an unacceptable financial or security risk.

12. Payment

You represent that you are authorized to use the payment method submitted with your order.

By submitting payment information, you authorize STORMCRAFT PC and its payment-processing providers to charge the applicable purchase price, taxes, shipping charges, and other charges disclosed during checkout.

Third-party payment providers may impose additional terms governing their services.

13. Taxes

Applicable sales taxes and other legally required charges will be calculated and collected where required.

Customers are responsible for applicable taxes, duties, fees, or governmental charges unless STORMCRAFT PC is legally required to collect and remit them.

PART III - SHIPPING, DELIVERY, RETURNS AND WARRANTY

14. Shipping and Delivery

Shipping availability, processing estimates, delivery estimates, and restrictions are described on our website, during checkout, or in our applicable Shipping Policy.

Shipping and delivery dates are estimates unless expressly guaranteed in writing.

Delivery may be affected by carrier operations, weather, natural disasters, holidays, supply constraints, address problems, payment verification, fraud verification, or other circumstances outside our reasonable control.

Customers are responsible for providing a complete and accurate shipping address.

Certain orders may require an adult or other signature upon delivery.

Customers should inspect delivered packages promptly. If your shipment arrives damaged, incomplete, incorrect, or appears to have been tampered with, please contact STORMCRAFT PC Customer Service promptly.

15. Lost, Stolen, Damaged or Misdelivered Shipments

Responsibility for lost, stolen, damaged, or misdelivered shipments will be determined according to applicable law, carrier records, our Shipping Policy, and the circumstances of the shipment.

If carrier tracking indicates that a package was delivered but you cannot locate it, please contact STORMCRAFT PC and the carrier promptly.

STORMCRAFT PC may reasonably require cooperation with carrier investigations, shipping claims, fraud investigations, delivery verification, signature verification, or law-enforcement reports where appropriate.

Nothing in this section limits rights available under applicable law.

16. Cancellation

Orders may be eligible for cancellation before processing or shipment.

Because orders can enter production or fulfillment quickly, we cannot guarantee cancellation after an order has been submitted.

Once an order has shipped, it generally cannot be canceled and instead may be subject to our Return Policy.

17. Returns and Refunds

Purchases made directly through STORMCRAFTPC.com are governed by the STORMCRAFT PC Return Policy applicable to the transaction.

The Return Policy establishes applicable return periods, eligibility requirements, RMA requirements, product-condition requirements, shipping responsibilities, inspection procedures, and refund procedures.

An approved Return Merchandise Authorization ("RMA") may be required before returning a product.

Products purchased through Amazon, Best Buy, Newegg, or another retailer generally must be returned through the retailer from which they were purchased and are subject to that retailer's applicable return policy.

Nothing in these Terms limits non-waivable consumer rights.

18. Return Packaging

Customers are responsible for packaging returned products appropriately to protect them during transportation.

Use of the original STORMCRAFT PC packaging is highly recommended whenever available.

Purchasing replacement packaging directly from STORMCRAFT PC is not required unless otherwise specified for a particular service.

If original packaging is unavailable, customers must use adequate packaging and protective materials suitable for shipping a desktop computer and its components.

To the extent permitted by applicable law, damage caused by improper packaging, inadequate protection, or improper handling during return shipment may not be covered by warranty and may result in reasonable repair, replacement, or other charges.

19. STORMCRAFT PC Warranty

Eligible new STORMCRAFT desktop PCs are currently backed by:

• 3-Year Labor Coverage
• 2-Year Parts Coverage
• 1-Year Ground Shipping Coverage for approved warranty repairs within the applicable service area
• Lifetime Technical Support

Complete warranty coverage, eligibility requirements, exclusions, RMA procedures, repair procedures, shipping coverage, and other warranty conditions are governed by the applicable STORMCRAFT PC Standard Warranty.

Extended warranties or protection plans, when offered, may be subject to separate terms.

Nothing in these Terms reduces rights that cannot legally be limited under applicable law.

20. Warranty Exclusions

Warranty coverage is subject to the exclusions contained in the applicable STORMCRAFT PC Warranty.

Depending on the circumstances, warranty coverage may exclude damage or failures resulting from accident, misuse or abuse, liquid damage, improper handling, unauthorized modification, improper installation, external electrical events, improper voltage, physical damage, improper return packaging, damage during unauthorized transportation, or causes unrelated to defects in covered materials or workmanship.

The applicable STORMCRAFT PC Warranty controls if there is any conflict concerning warranty coverage.

21. Technical Support and RMA Procedures

Customers requesting warranty service may be required to complete reasonable troubleshooting before an RMA is approved.

Products should not be shipped to STORMCRAFT PC without appropriate authorization.

STORMCRAFT PC is not responsible for unauthorized shipments or products sent without sufficient information to identify the customer, order, or service request, except to the extent otherwise required by law.

PART IV - SOFTWARE, DATA AND THIRD PARTIES

22. Software

STORMCRAFT PC systems may include operating systems, drivers, firmware, utilities, applications, promotional software, game codes, or other software supplied by third parties.

Third-party software is governed by the applicable provider's license agreement and terms.

Your purchase of a STORMCRAFT PC system does not transfer ownership of third-party software or intellectual property except for the license rights granted by the applicable provider.

23. Customer Data and Backups

CUSTOMERS ARE RESPONSIBLE FOR MAINTAINING BACKUPS OF IMPORTANT DATA.

Troubleshooting, repair, replacement, operating-system restoration, drive replacement, system reset, or other service may result in deletion, corruption, or loss of data.

Before sending a system for service, customers should back up important files and remove confidential or sensitive information where reasonably possible.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, STORMCRAFT PC IS NOT RESPONSIBLE FOR LOSS OR CORRUPTION OF CUSTOMER DATA ARISING FROM PRODUCT FAILURE, TROUBLESHOOTING, REPAIR, REPLACEMENT, OR SERVICE, EXCEPT WHERE LIABILITY CANNOT LEGALLY BE EXCLUDED.

24. Third-Party Services and Links

Our Services may contain links to or integrations with third-party websites, payment processors, financing providers, shipping carriers, manufacturers, software providers, social-media platforms, or other services.

STORMCRAFT PC does not control these third parties.

Unless expressly stated otherwise, a link or integration does not constitute our endorsement of the third party.

Your use of third-party services may be governed by separate terms and privacy policies.

To the maximum extent permitted by applicable law, STORMCRAFT PC is not responsible for third-party websites, services, content, availability, security, or business practices.

PART V - CONTENT AND INTELLECTUAL PROPERTY

25. STORMCRAFT PC Intellectual Property

The Services and their content, including STORMCRAFT PC names and trademarks, logos, product names, product designs, photographs, videos, graphics, website designs, text, product descriptions, marketing materials, and other content, are owned by or licensed to STORMCRAFT PC and are protected by applicable copyright, trademark, trade-dress, and other intellectual-property laws.

Except as expressly authorized by us or applicable law, you may not reproduce, modify, distribute, republish, display, sell, license, commercially exploit, scrape, or create derivative works from our content.

Third-party trademarks and intellectual property remain the property of their respective owners.

26. User Content

If you submit reviews, comments, photographs, videos, testimonials, suggestions, questions, or other content ("User Content"), you represent that you have the right to submit it, it does not violate applicable law, it does not infringe another person's rights, and it does not contain malicious or unlawful material.

By voluntarily submitting User Content, you grant STORMCRAFT PC a non-exclusive, worldwide, royalty-free license to use, reproduce, display, distribute, adapt, and publish that content for purposes related to operating, supporting, improving, or promoting STORMCRAFT PC and its products and Services, subject to applicable law and our Privacy Policy.

We may remove User Content that violates these Terms.

PART VI - PROMOTIONS AND MARKETPLACES

27. Promotions, Bundles and Promotional Codes

Promotions, sweepstakes, giveaways, rebates, bundles, free gifts, game codes, and promotional codes may be subject to additional terms, including expiration dates, quantity limitations, geographic restrictions, product restrictions, customer eligibility requirements, or separate official rules.

STORMCRAFT PC may modify or cancel a promotion where permitted by law if fraud, technical problems, unauthorized activity, or other circumstances interfere with its proper operation.

Digital products, promotional codes, game bundles, or manufacturer promotions may also be subject to third-party terms.

28. Third-Party Marketplace Purchases

STORMCRAFT PC products may be sold through authorized retailers and marketplaces.

Purchases through third parties may be governed by the retailer's terms of sale, payment procedures, shipping policies, cancellation policies, and return policies.

The applicable STORMCRAFT PC product warranty may separately apply to eligible products purchased through authorized retailers.

STORMCRAFT PC is not responsible for unauthorized sellers or representations made by unauthorized third parties.

PART VII - DISCLAIMERS AND LIMITATION OF LIABILITY

29. Website Disclaimer of Warranties

THE FOLLOWING DISCLAIMER APPLIES TO THE WEBSITE AND ONLINE SERVICES AND DOES NOT REPLACE THE EXPRESS STORMCRAFT PC PRODUCT WARRANTY.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE WEBSITE AND ONLINE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.

WE DO NOT WARRANT THAT THE WEBSITE WILL ALWAYS BE UNINTERRUPTED, ERROR-FREE, COMPLETELY SECURE, OR FREE FROM HARMFUL COMPONENTS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, STORMCRAFT PC DISCLAIMS IMPLIED WARRANTIES RELATING TO THE WEBSITE AND ONLINE SERVICES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, EXCEPT WHERE SUCH WARRANTIES CANNOT LEGALLY BE DISCLAIMED.

NOTHING IN THIS SECTION DISCLAIMS OR REDUCES THE EXPRESS STORMCRAFT PC PRODUCT WARRANTY OR RIGHTS THAT CANNOT BE WAIVED UNDER APPLICABLE LAW.

30. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, STORMCRAFT PC AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES, AND AGENTS WILL NOT BE LIABLE FOR SPECIAL, INCIDENTAL, INDIRECT, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM OR RELATED TO THE SERVICES, PRODUCTS, OR THESE TERMS, INCLUDING LOSS OF PROFITS, LOSS OF BUSINESS, LOSS OF USE, OR LOSS OF DATA, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, STORMCRAFT PC'S AGGREGATE LIABILITY ARISING FROM OR RELATING TO A PARTICULAR PRODUCT PURCHASE WILL NOT EXCEED THE AMOUNT ACTUALLY PAID TO STORMCRAFT PC FOR THE PRODUCT MOST CLOSELY RELATED TO THE CLAIM.

FOR CLAIMS RELATING SOLELY TO USE OF THE WEBSITE OR ONLINE SERVICES AND NOT TO A PRODUCT PURCHASE, STORMCRAFT PC'S LIABILITY WILL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.

THESE LIMITATIONS APPLY REGARDLESS OF WHETHER A CLAIM IS BASED ON CONTRACT, WARRANTY, TORT, NEGLIGENCE, STRICT LIABILITY, STATUTE, OR ANOTHER LEGAL THEORY.

THESE LIMITATIONS DO NOT APPLY WHERE LIABILITY CANNOT LEGALLY BE LIMITED OR EXCLUDED.

Some jurisdictions do not permit certain exclusions or limitations. In those jurisdictions, these provisions apply only to the maximum extent permitted by applicable law.

31. High-Risk Uses

Unless expressly agreed to by STORMCRAFT PC in writing, STORMCRAFT PC consumer computers are not designed, manufactured, tested, or certified for use in applications where computer failure could reasonably be expected to result in death, serious bodily injury, or severe property or environmental damage.

This includes, without limitation, life-support systems, safety-critical medical systems, aircraft-control systems, nuclear-control systems, emergency-response control systems, and similar safety-critical applications.

PART VIII - INDEMNIFICATION AND DISPUTES

32. Indemnification

To the maximum extent permitted by applicable law, you agree to indemnify, defend, and hold harmless STORMCRAFT PC and its affiliates, officers, directors, employees, representatives, and agents from third-party claims, liabilities, damages, losses, and reasonable costs and expenses, including reasonable attorneys' fees, arising from your unlawful or unauthorized use of the Services; your material breach of these Terms; your violation of another person's rights; User Content submitted by you that infringes another person's rights; or fraudulent or unlawful activity conducted through your account.

You agree to reasonably cooperate in the defense of an applicable claim.

STORMCRAFT PC may assume control of the defense of a matter subject to indemnification at its own expense.

You may not settle a claim in a manner that imposes liability or obligations upon STORMCRAFT PC without our prior written consent.

This section does not require indemnification where prohibited by applicable law or to the extent a claim results from STORMCRAFT PC's own conduct.

33. Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU AND STORMCRAFT PC AGREE THAT ANY DISPUTE, CLAIM, OR PROCEEDING ARISING OUT OF OR RELATING TO THESE TERMS, THE SERVICES, OR A TRANSACTION WITH STORMCRAFT PC WILL BE BROUGHT AND RESOLVED ONLY ON AN INDIVIDUAL BASIS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER PARTY WILL SEEK TO HAVE A DISPUTE HEARD AS A CLASS ACTION, COLLECTIVE ACTION, CONSOLIDATED ACTION, REPRESENTATIVE ACTION, OR PRIVATE ATTORNEY GENERAL ACTION.

THIS SECTION DOES NOT LIMIT ANY RIGHT THAT CANNOT LAWFULLY BE WAIVED.

34. Governing Law

These Terms and disputes arising from or relating to these Terms or the Services are governed by the laws of the State of California and applicable federal law, without regard to conflict-of-law principles.

Nothing in these Terms deprives a consumer of protections that cannot legally be waived under applicable law.

35. Venue

To the extent permitted by applicable law, any judicial proceeding arising out of or relating to these Terms, the Services, or a transaction with STORMCRAFT PC shall be brought in an appropriate state or federal court located in the State of California.

The parties consent to the jurisdiction of such courts to the extent permitted by applicable law.

Nothing in this section prevents a consumer from bringing a claim in another venue where applicable law provides a non-waivable right to do so.

PART IX - GENERAL PROVISIONS

36. Privacy

Our Privacy Policy governs our collection, use, disclosure, retention, and protection of personal information.

By using our Services, you acknowledge our Privacy Policy.

Applicable privacy choices and rights are available as described in that policy and through any privacy controls provided on our website.

37. Electronic Communications

By using our Services, creating an account, or placing an order, you consent to receive transaction-related communications electronically.

These communications may include order confirmations, payment notifications, fraud-verification requests, shipping notices, delivery notices, return and refund communications, warranty and RMA communications, security notifications, and account-related communications.

Marketing communications are subject to applicable law and available unsubscribe or preference mechanisms.

38. Changes to These Terms

We may update these Terms periodically to reflect changes in our Services, products, policies, business practices, or legal requirements.

When these Terms are updated, the "Last Updated" date at the beginning of the Terms will be revised.

Revised Terms will apply prospectively from their effective date unless applicable law provides otherwise.

Where legally required, we will provide additional notice of material changes.

Continued use of the Services after revised Terms become effective constitutes acceptance to the extent permitted by applicable law.

39. Assignment

You may not assign or transfer your rights or obligations under these Terms without STORMCRAFT PC's prior written consent.

STORMCRAFT PC may assign or transfer its rights and obligations in connection with a merger, acquisition, corporate restructuring, financing, sale of assets, change of control, or other lawful business transaction, subject to applicable law.

40. Severability

If a provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed where necessary.

The remaining provisions will remain in full force and effect.

41. No Waiver

Failure by STORMCRAFT PC to exercise or enforce a right or provision under these Terms does not constitute a waiver of that right or provision.

A waiver on one occasion does not constitute a waiver on another occasion.

42. No Third-Party Beneficiaries

Except where expressly stated otherwise, these Terms do not create rights or remedies for any person or entity other than you and STORMCRAFT PC.

43. Entire Agreement

These Terms, together with the STORMCRAFT PC Privacy Policy, Return Policy, Shipping Policy, applicable Warranty, promotional rules, order-specific terms, and other policies expressly incorporated by reference, constitute the applicable agreement between you and STORMCRAFT PC regarding the Services and applicable transactions.

If a product-specific, warranty-specific, promotional, or transaction-specific term directly conflicts with these general Terms, the more specific applicable term will control to the extent of that conflict.
